The Code of Civil Procedure, 1908 is a Procedural Law . This law publish as Gazzette on 21th March 1908 and commence from the 1st day of January ,1909.It constitutes with 158 sections,51orders &5 Schedules.
Difference between Section & OrdersDifference between Section & orders as to state ,section is prefers over orders . Sections are amendable by the Parliaments and orders is amendable by the both Supreme Court of Bangladesh and by the parliament.
Subordination of Civil Court
The steps of subordination of civil Court has been stated under section 3 of The Code of Civil Procedure ,1908 as –
- High Court Division
- The Court of District Judge
- The Court of Additional District Judge
- The Court of Joint District Judge
- The Court of Senior Civil Judge
- The Court of Civil Judge
- The Small Causes Court
- The Court of District Judge
- The Court of Additional District Judge
- The Court of Joint District Judge

Classification of decree
There are mainly 2 types of decree- preliminary Decree
- Final Decree
- Contested Decree which is under 96(1) of CPC
- Experte Decree under section 96(2) of CPC
- Compromise Decree under section 96(3) of CPC.
What is contesting Decree ?
Under section 2(2) of The Code of Civil Procedure if both parties any of a civil suits attend in the court, take part with hearing with evidence as wel as plaints & written statements try the suits with oral & wriiten evidence, then after pass the judgment to declare decree is contesting decree.
It means if the judgment & decree is passed based on merit , called contesting decree.
